childs last name change

My two year old child has her fathers last name. We were never married. Is there a way that I can change her last name to mine without him having to sign anything? He hasn't seen her in seven months and I don't want to confuse her.

It may be possible to do this. Normally, it takes both parents to change the name of a minor. However, if one parent refuses, or is unavailable to execute the petition, and the notice of filing is properly served, the District Court can grant the name change.
