Legal Question in Family Law in Kentucky

I am under court order to pay the 1st and second mortgage on my home. I am in the process of finalizing a divorce. An agreement was reached by my soon-to-be ex-wife and her attorney four months ago for her to take over the first mortgage and thus, I will deed over my interest in the home to her.

My question is this: If I have a written agreement from my wife's attorney dated in August '10 stating that they will assume the mortgage responsibility, is it safe to assume that I can argue that she be responsibile for the mortgage payments from Aug, Sept, and Oct?

I wouldn't assume anything. I'd ask her attorney to sign an agreed order to that effect and get it entered into the court's record.
