Legal Question in Family Law in Kentucky

custodial interference

Can a grandparent be charged with custodial interference for not allowing court ordered visitation at the request of the custodial parent when that parent isn't there? Can the custodial parent be charged even though he was not present? Why wouldn't the police get involved when I have a court order that show when and what time I am to pick up my child?

Re: custodial interference

Grandparents could be charged, but I suspect the police would not see this as so eggregious to fall in the criminal realm. Rather, the best approach is to bring the parent back in to court on a "show cause" motion. They judge may hold the custodial parent in contempt for the grandparents actions because they allowed it to occur.
