Custody

Our 18 yr old daughther has a 9 mo old. The father recently went to an attorney to have papers filed with court to pay child support. They now are sending something about open end custody case. The baby lives with us in KY the father lives in Indiana. He says he is not trying to get custody-what is an open end custody case?

If the "open end custody case" has been filed int Indiana, then you need to object to Indiana having jurisdiction. The jurisdiction needs to lie where the child resides or you will potentially have real problems. You need to do this quickly. It would also be wise to consult with an attorney and show them how your daughter was served to see if she has even been properly brought before the court. If she hasn't and you respond without objecting to personal jurisdiction, then you could inadvertently waive it.

It is complicated as you can see, but you do not want a custody case proceeding in another state.
