If my daughters dad hasn't been involved in her life for 3years now and don't want her can I file abandonment against him and gain sole custody?

You have grounds to move the court to grant you sole custody. Abandonment is actually a ground for terminating a parents rights. Even a parent who does not have custody still retains parental rights. So, you may want to clarify if you want to end his custody or end his parental rights. The former is easier than the latter.
