Declaration of Invalidity
In 2003 I married a man whom I dated for approximately a year. I entered the marriage with one female child of six years in age. After much labored prayer and four months into the marriage, my husband advises me the marriage is not going to work and he leaves. Once he left the premises it got worse with stalking, phone calls, etc. I decided for the safety and security of my child it would be in our best interest to move. I decided to conduct my own investigation of this husband of mine. I started with a Kentucky State back ground check. He had a felony of three counts of Sexual Abuse. I obtained the court records and found out this man had molested his step daughter, twelve years under age. Further into my investigation I found out he had divorced another woman three days prior to our marriage. I've taken upon myself (financial reasons) to prepare a Declaration of Invalidity on the grounds of fraud. Grounds on misrepresentation, concealment, infidelity. KRS clearly states filing can be no later than ninety days after the petitioner obtained knowledge. Any advice or opinions would be very much appreciated.

Annulment of marriage can be a difficult action and must be specifically pled to the court. i would advise an in depth consultation with an attorney before attempting to do this yourself due to the complicated nature of annulments. I do believe, however, that you would have a strong case to annul your marriage, but would ened to review the law and facts in more detail to be sure.
