Legal Question in Family Law in Kentucky
Division of property in case of death or divorce
My husband and I have been married for 1 year, and have no children. He spoke to a lawyer before we were married, and was told that in case of his death, I would recieve half and his parents would receive half of our property. Is this true? In that case, if I died, my parents would recieve have of our property. This does not make sense to me. The same lawyer told him that a will is only a wish, and is a waste of time, because the family members will split things up how they want. Also, I was told that if we divorced, he would leave with an amount of property valued at what he owned before we were married, even if that land had been sold and other land purchased while we were married. Please clarify this issue for us.

There are numerous ways to deal with property and too complicated to go into here. Suffice to say that the scenario you describe does not have to happen in most instances. Go speak with a reputable real estate attorney in your area. You will be pleased with the options that will be presented to you.
