Re: Divison of property

Several things occur to me.

First--if the home is your rental, and you have kicked him out, you have every right to keep him out. Get police assistance if you have to.

On the other hand, you cannot keep his property. That is called conversion, and he can sue you. If serious enough, you might wind up with a theft charge.

You need to make sure you keep his property safe, and return it to him as quickly as possible. Inventory it, take pictures, and get a friend to help so you have a witness to the condition it's in, and what all is returned to him.

Any attorney who handles domestic cases (divorce, etc.) can assist you with this. If you are in fear of violence or property damage, you might be able to obtain an Emergency Protective Order. The Circuit Clerk at the courthouse may be able to assist you in filing a request for one. The Sheriff in your county should be able to assist you with this also.
