Own Divorce

My husband and I have been seperated for 17 mos. Do I have to file a (MSA) and Financial Statements along with the petition for dissolution. No children,property or joint debts involved.

The best way to get an answer to your question is to as the Circuit Court clerk in the county where you are filing the action.

I am assuming that you are filing the divorce yourself, through a self-help agency. You will need to check with the county clerk and find out if they require the financial statement. Not all counties require this, but you will need a property settlement agreement ("MSA"), even if you have already divided the property and debts.

Even if you are filing an "uncontested" divorce, you should have an attorney preparing your divorce documents and guiding you through the process to ensure that all the court's requirements are fulfilled. Contact me if you are in the central KY area.
