Legal Question in Family Law in Kentucky

divorce question

I woke up one morning and my car and wife were gone and my bank account was overdrawn. I have since learned that my wife flew to move in with a man she met online leaving me and our 12 yr old child ( we have been married for over 13 yrs. I am not positive where she is residing but have had very limited email contact. Is this abandonment in the eyes of KY law?

I would need to know the context of why you are wondering if this is "abandonment". If you mean in terms of divorce, Kentucky is a no fault divorce state, so it her taking off does not change whether or not you can get a divorce. If you mean in terms of obtaining custody, then it depends more on how long she has been gone and any attempts at contacting your child or paying support. I recommend seeking custody now while she is gone.
