Legal Question in Family Law in Kentucky

divorce

Should I sign a quit-claim deed as part of divorce? My name will be on the mortgage until the home is sold. I will not be living in the home.

Re: divorce

I would advise against signing a quitclaim deed as long as your name remains on the promissory note. Sometimes this is confused with the mortgage. A mortgage only allows the lendor to come after the property. A note (loan agreement) allows the lendor to come after you personally. So, you need to insist on being off the note before relinquishing title to the property.
