my son & his wife were divorced in November 2005. They are living together again as a married couple since December 2006. His job takes him out of state anywhere from 1 - 6 weeks at a time. He quit paying his child support. They both use the same bank. His money is direct deposit into his account on Thursday night and she transfers it to her account on Friday morning. She added her name to his checking account but he is not on hers. He is suppose to pay $1100. monthly but since December he has given her over $12,000. proof being bank statements showing transfers. They do not plan to get married just stay as they are. In the event they split again, can she come back and say he never wrote her a check for child support. His bank does not send back copies of checks anyway.

The child support order remains in place and active. If the child support always went straight to her instead of going through the County Attorney's office, then he can offer bank statements as proof of payment if she does make that argument.
