Legal Question in Family Law in Kentucky

me and my fiance are getting two of his children from a previous relationship. the children are coming to live with us permantley but the mother doesnt want to give up her foodstamps and childsupport and lives in washington dc. . what can we do? should we have her sign over custody or what? there has never been custody established on the children so what rights does my fiance have?

If custody has never been legally established, then I would recommend filing a motion to establish custody here in Kentucky as soon as they have been here for 6 months. The rest would fall into place from there. If you pursue something sooner, the proper jurisdiction would be Washington, DC.
