Re: grandparent rite

A grandparent only has the right to ask the Court for visitation. The Court recognizes the right of a parent to say who the child is with and will only overrule the parent and award visitation to the grandparent if and only if it finds that such visitation would be in the best interest of the child. A lot of factors are involved. Each case is different. A lot depends on the prior relationships between grandparent and child. Prior to the statue being passed, the grandparent could not even ask for visitation. The only way to approach this is for you to consult an attorney experienced in domestic relations (divorce law). Let him/her review your situation and advise you in light of the sitting court, etc. Again, the only right is the right to ask, not to receive.
