Legal Question in Family Law in Kentucky
Grandparents Rights and Custody
I had a question on here earlier and I can figure out how to add to it... but Im 20 yrs old and my fiancee is 22, he was adopted when he was 5 by his grandmother. i am currently 5 months pregnant and his grandmother is already saying that she has grandparents rights and that if I dont let her see my child when she wants she will take me to court for visits and possibly even custody... I have never been in any kind of trouble, done drugs, or alcohol... She is just a troublemaker and she says that since she is my fiancees next of kin that she will be able to get visitation. honestly I dont want my child around her at all because she is very rude and talks horrible about me excessively about so many things which mostly are untrue I just dont want my child to have to hear these horrible things about me or his father... Does she have any rights to my child after hes born?

Re: Grandparents Rights and Custody
Grandmother has not rights regarding your child. There is a statute in Kentucky that seems to give grandparents visitation rights, however, a US Supreme Court decision basically takes all the bite out of that statute. If you and the father do not want her to have contact, then that statute will not force you to allow contact.
What you need to be aware of is the possibility that she will make exaggerated or false reports to the Cabinet for Health and Family Services. There is no way to stop that except to live right and take care of your child.
