Grandparents rights

My husbands parents and sisters have refused to see, write, or call our daughter in 8mo. About a month ago his mother threatened to take us to court for "grandparents visitation". Can she legally do this? She refused to believe that our daughter was even her grandchild for my entire pregnancy. Should I get an attorney or wait untill they file against us?

KYlaw provides for reasonable visitaiton rights to grandparents, but only if it determines that it is in the child's best interest to do so. Courts have usually applied this law in a divorce setting or in a paternity case when the parents aren't married and the grandparents have a close bond with the child. Your case is different. If the grandparents are refusing the see the child, but want grandparent visitation rights instead of simply asking you to see the child, I think it is unlikely that the court would find any extended grandparent visitation to be in the child's best interest.
