Legal Question in Family Law in Kentucky

husband never paid according to decree, and wants home now

my divorce finalized in may 2005,in the decree husband was ordered to pay half the credit card bills,as i was unemployed & obtained home, marital debt and he lived with parents. he was ordered to pay half of debt up to sept, 2004(we separated july 2003),after comparing income (i used cards to buy groceries, etc.)& later became unemployed.he has since refused to pay this and his atty stated he would just file bankruptsy should i pursue this.i was to obtain marital home as long as his name removed by sept. 2006. now husband is taking me to court to move that date up due to me being recently unemployed again and have filed bankruptsy myself just on credit card debt, that he never pd half on,after losing job,i became 3 months behind on mortgage and husband having a large savings acct because of no bills, made the payments and is now wanting sept,2006 date moved up so that he may refinance with his parents co signing to remove my name off the deed.does me being unemployed have an affect on the comissioner changing his decision, and also the fact that husband never pd anything on debit that caused me to file bankruptsy, maybe help me out. court is 2/07/06,atty dropped me after i pd $1800 and had no more money.im without atty this time too

Re: husband never paid according to decree, and wants home now

He still owes what the court ordered. He is subject to contempt and possible jail even if he does file for bankruptcy. Raise the issue with the judge. You may also be entitled to equity payments in the house, etc. Go back to your attorney anyway and see if he will help. There may be someway the your ex might have to contribute to some attorney fees. I do not have all of the facts in front of me and can only relate to your question. If your old attorney can not help you, see someone else. You may be surprised at what you can afford.
