Legal Question in Family Law in Kentucky

My husband is a retired 100% disabled Army Veteran with one child. He was ordered to pay spousal and child support which he has never been lateon his payments. His ex wife has threatened to take him back to court for more child support. She claims she needs money to send their daughter to college. Their daughter will be 18 years old in February 2011. The military will pay all of her college fees and expenses plus give her 8-9 hundred dollars a month for living expenses as long as her grades are of standard. He will buy her a new Passat Voltswagon car but ask the mother to pay the insurance. She doesnt want to do that though she is employeed by the government. The divorce was final in Kentucky 2006. Can she still receive more support under these circumstances?

Based on what you described she cannot win more support. Unless there is a settlement agreement entered into the divorce that says otherwise, Kentucky does not require support of a child over age eighteen unless that child is in high school. Even then, support ends at age 19. There is no legal basis for trying to make someone pay for a child's college education. There is no legal basis for the Volkswagon either, so he does not need to feel like he has to settle with her again. If there is a settlement agreement, be sure to go back and read the terms.
