Legal Question in Family Law in Kentucky
Do you think my husband will get his child visitation modified?
1. My husband has a nine yr old son with his ex wife. He gets him every other weekend, one week in the summer, and alt holidays. His ex always takes thanksgiving, Christmas eve and Christmas.
2. My husband is asking for all holidays, school breaks, days off school, etc for odd years, she can have even years. This would include the child's birthday. And 6 weeks in the summer.
3. My husband has enstage kidney failure and is on dialysis. He is not elliagable for a transplant at this time. Drs are telling him he has 10 years if he's lucky.
4. The ex-wife tells the child daddy isn't really sick. If my husband is in the hospital and misses a weekend, she won't switch and she tells the child " daddy dosent love you so he isn't picking you up".
4. When he is with us for a weekend she drills him when he gets home, and makes him feel guilty for going.
5. The child has made comments that he hates his life and wants to die because he is stuck in the middle. He is in counseling and on meds.
6. My husband wants to spend as much time with his child as he can.
We have court on Thursday. The court appointed a lawyer for the child, and that lawyer even said the ex wife is vindictive and is trying to come between the child and his dad.
Any idea what the judge will say?

There's no way of predicting how the judge will rule. All you can do is present your evidence in court and try to persuade the judge that increasing visitation is in the best interests of the child. Hopefully you have an attorney. Good luck.
