Legal Question in Family Law in Kentucky
My husband of 27 years has a 34 year-old daughter who is indigent (unemployed, homeless), has a history of drug abuse and violence, and now a 7 month-old son whom is in our temporary custody. We retired in January of 2008, and neither of us want to raise the grandchild. I am concerned about our limited marital assets and resources, and the potential drain on these by the daughter. My husband plans to buy her a house for her and her son, but the situation will be prolonged indefinitely before she will regain custody of the child, if at all. I fear she will abandon the child in the future. What can I do to protect myself, as I fear that this situation is going to be prolonged indefinitely.

It appears that there are multiple questions roled up into the one question of "What can I do to protect myself?" and so getting an answer through this forum may be impractical. I am assuming your main concern is financial. If the grandchild came to you as a result of social services intervention, you should qualify for Kinship Care money and medical coverage for the child. As for protecting yourself financially from what your husband may do in helping his daughter, that is a rather complex issue and would be driven by many factors. You would not want your name on any loan and you would not want any marital property, such as your residence, encumbered by a lien/mortgage in financing things for his daughter. Beyond that, you really would need to consult with an attorney who can ask all the right questions for your situation.
