me and my husband were together for 6 years--he left the state with another woman 12 years ago and i have'nt seen or heard from him since (we are still married) how can i go about getting a divorce? we have no children together and i am on s.s.i. disability. what can i do to become divorced. i have no idea where he is or how to get ahold of him. please help!! You can get a divorce and not know where he is. When you file the petition for dissolution of marriage, you will need to have a Warning Order Attorney appointed to attempt to contact him and file a report with the court of his/her findings, before the divorce action can proceed. Often times that report simply states that the Warning Order Attorney could not locate that individual to notify him/her of the action. And that's okay, the divorce can still go forward.
Also, since you are on SSI, you should contact your local Legal Aid office or local bar association for available pro bono legal services in your area. You can also get your filing fees waived, by filing a motion in forma pauperis, which means that you do not have the resources to pay the fees. You are legally entitled to a divorce, even if you cannot afford to pay for one.
