How do you get a "joint custody" set in place before a divorce? We live in Morehead, KY and my son is having a battle with his wife to see his daughter.

Once a divorce petition is filed, a party can file a motion for temporary relief, which includes designation of custody, during the pendency of the action. If the divorce action has not been filed yet, then there's your answer: he needs to file for divorce. That will also prevent his wife from disposing of any marital assets in the interim, as a "status quo" order will also be entered.
