Legal Question in Family Law in Kentucky
What if I just...leave the state?
My husband was falsely accused of molesting our oldest daughter by a DCFS worker - NOT our daughter - criminal charges were dropped, but Family Court pursued and removed custody from the both of us (from myself for believing in my husband's innocence). I've since had custody of our children returned, but he has not and therefore are not able to legally live together as a family anylonger. If we were to move out of state, with no criminal charges pending on either of us, can Family Court pursue, issue a warrent, etc. on either of us if we nolonger are there to cooperate with them?

If the Family Court has not retained jurisdiction and an ability to monitor your living arrangment through a series of review hearings, you would be able to move away from the State. You and your husband cannot have any Court Orders which limit your ability to relocate with your children without judicial approval.
