Is a physical seperation of more than one year considered a legal seperation?

A legal separation is obtained by filing a petition and having a court approve the written separation agreement which sets out the rights of the parties. In most cases, a divorce petition is filed and the parties reach an agreement, which is approved by the Court, which will define their rights until the dissolution of the marriage.
