Legal Question in Family Law in Kentucky

I live in Ky. I have a court order stating that I can claim my daughter on the odd years, if I am current with my child support. And I am. So I go to e-file my taxes and they were rejected because my ex. already claimed her....what's my next step??

Hello and thank you for choosing LawGuru!

You need to file your taxes, in paper form, claiming your daughter. The IRS will investigate and discover the court order gives you this right and should allow you to claim her.

You may also want to discuss this with your ex-wife to gain her cooperation in correcting this issue. As leverage, you may suggest to her the possibility of filing a motion to enforce that court order and ask the court to find her in contempt of that order and request that she be ordered to pay your attorney fees for such a motion.

Please let me know if there is anything else I can do for you. Good luck!
