Legal Question in Family Law in Kentucky

I now live in SC and have for almost a year and the father of my 15 month old lives in KY. Can he file for custody in KY or does it have to be in the state where the baby is living?

An original custody petition should be filed in the state in which the child has resided for the prior 6 months if there has never been a case involving the child previously. If there was a child support, visitation or custody case filed in Kentucky already, then you may have to contest the issue in KY or try to have that case transferred.
