Maintenance

In my separation agreement, my exhusband was to begin paying maint. on Feb. 1, 2007 and continue for 6 months. There was no agreement as to when I had to be out of our residence, and the property was ''amicably divided''. He refused to pay the maint. in Feb. because I didn't vacate the premises until the middle of the month, and he is refusing to pay now at all because he is alleging I structurally damaged the house (I did not and have witnesses). He also is claiming I took property that I should not have taken (a range that was not listed or mentioned in the settlement agreement). I have received no money from him since Dec. 23, 2006, and was unemployed until January 11th, 2007. Can he legally refuse to pay maintenance?

No, he cannot. However, you will have to file a motion to enforce the order with the court. He can be held in contempt.
