Legal Question in Family Law in Kentucky

I am currently married and want to file for divorce from my husband who has his business in his name as an LLC. My name is nowhere on any documents associated with the business. He is in serious financial trouble with his business. I would like to know if any of that debt from his business can touch me or how would that be handled? He shows no income from it because it is not making a profit, but he does pay himself. We have a 15 year old and I would need child support. How would that work with him showing no income?

Hello and thank you for choosing LawGuru.

First, he does have income if he's using the LLC to pay himself. If at some point he doesn't have income then it's typical for the court to impute minimum wage to him and base the child support obligation on that. You need to retain an attorney to protect your interests. Feel welcome to contact me at [email protected] if you need anything else.

I hope this has helped. Good luck!
