Legal Question in Family Law in Kentucky
Military Retirement Pay
I was divorced in Kentucky in 1983, I was married for 12 1/2 years to an active duty service member. Am I still entitled to a portion of his military retirement pay? I currently reside in Colorado, he in Texas. He retired after 20+ years of service in the Army. If I am entitled, what do I need to do, approximately how much will it cost and how do I find an attorney that will handle this for me? Thank you.

Re: Military Retirement Pay
If you were entitled to a portion of your ex's military retirement at the time you were divorced, then you may be able to make a claim for it on a fraud or excusable neglect basis. That would have to be done within the original divorce case and the result, if favorable, filed in TX and a division order placed with the military.
It is difficult to estimate the cost at this juncture, but expect to incur some substantial legal and administrative costs [LD telephone,etc.].
Our recommendation is to contact a KY attorney practicing domestic relations law and request an initial consultation and case evaluation. They are usually done at no charge.
