Paying Maintenance to Exwife
After nineteen years of marriage my wife and I
divorced in 1992. We had no children and she didn't
make much money on the job she had at the time. But
she has been employed at a local hospital now for
approximately seven or eight years and has a good
income. She and her sister have bought a house in the
fifty thousand dollar range and they live together in
it now. I became disabled in Sept. of 2000 and now live on railroad disability. I have paid maintenance
in the amount of 350.00 a month ever since we were
divorced. And now that she has moved into the house
with her sister, she rents out a mobile home that
she lived in herself. I would like to know if I have
any chance of ending the maintenance.

I do not know whether your maintenace was established by agreement or by the Court. At any rate it would be wise to seek the advice of local counsel to see what change of circumstances may do in your particular case. All cases are different so don't rely on what other have done.

Of course, every situation is different. In your situation, from what you have said, it sounds like you have a fair chance of getting your maintenance payments stopped or at least reduced.

One must look to the divorce decree. Was the sustenance alimony treated as a property distribution or not. The Court retains jurisdiction to modify, if the decree says it does
