Legal Question in Family Law in Kentucky

I am planning to divorce my husband of 5 years, we have no children and currently live across the street from eachother, and still have sexual relations from time to time, he is currently involved in a personal injury suit and will most likley recieve a settlement. Am i entitled to any portion of that settlement?

First, if you are able to get along well enough to do as you described, I really hope you will reconsider the whole divorce thing.

Second, any portion of his recovery that he gets for lost wages during the time of the marriage would be a marital asset and divisible. However, it is unlikely that pain and suffering or future wages would be divisible.
