Legal Question in Family Law in Kentucky
Pregnant and scared of upcoming custody battle
I am currently 4 months pregnant and recently left the soon the be father in which i was living with due to violence. No formal charges were ever filed, however the police did come to our home on 2 occasions and documented it. The father has a medical record of bipolar disorder and is not currently on medication. Also, he was honorably discharged from the army due to failure of a urine analysis of marijuana. He also has a felony charge of kidnapping and invasion and well as many charges all including violence, however some were committed prior to age 18. Also, an incident where he violently attacked a commanding officer in the national guard while called to active duty occurred shortly before his leave for Iraq and resulted in him no longer going. I live in Kentucky and am worried about the fathers threats on taking our child when he/she is born due to his mother's well off financial situation. I have no history of drug abuse or physical. What are my rights? What are his? What is likely to happen when we go to court after the baby is born? Will his military records help and if so can they even be brought into the court trial. Please help.

Re: Pregnant and scared of upcoming custody battle
If you are a fit parent and the things you say about him are able to be documented/proven to the court, then you are in a good position to maintain sole custody of your child. The only thing his mother's finances do is enable him to hire an attorney that will likely try to exhaust you financially and emotionally.
So, you need legal counsel. If you do not have money yourself, I suggest you go to a domestic violence program as soon as possible and find out what resources they have to assist your.
