If a spouse signed legal papers on 9-08-08 that he would give 1/2 of his retirement benefits as of 8-01-08 - can he recind that because his original amount has dropped due to the stock market fiasco???

If it was part of a court order, then most likely not.

If only part of a contract, then he could make an argument, but still should not be successful.

You need to get your QDRO signed by the court quickly, however, so you can get something out of the 401k while there is still funds available.
