refinancing loans due to divorce
My brother is getting divorced his truck is titled in both of their names. Does the wife have to sign off the title before he can refinance?

Usually most marital assets are frozen during the pending of a divorce. If this is the case for his truck, he would need his wife's approval to sign it over without the chance of a contempt motion against him. Even so, under normal circumstances, both he and his wife would need to sign over a transfer. The loan is another matter. The lender may allow him to assume the entire loan regardless of how the truck is titled.
