Legal Question in Family Law in Kentucky

right to relocate out of state

What are my rights as a single parent with residential custody to leave the state of Kentucky and relocate to a state 6 hours away? Are there circumstantial situations that would in fact make this move possible such as job promotion or marriage to a resident of different state?

Whether you have Sole or Joint (shared) custody, be prepared for a fight over the move. The test is "what is in the best interest of the child". If you have sole custody, you're already a step ahead, and the non-custodial parent has an uphill battle. If it's joint custody, it's and easier burden of proof for the non-residential parent to change residential custody. Either way, you'll likely wind up back in court at the very least to work out a different visitation pattern, if not in a full blown custody battle. Good luck.
