Legal Question in Family Law in Kentucky

Relocation with Children during Separation

I want to move 300 miles away (still in KY) with my 2 children. I want to separate from my husband because he is an alchoholic, and will not change after 9yrs of marriage. I would be moving to Northern KY to be with my family who lives there, so I'd have some support. I have NO family here (besides kids), and I can't afford to live on my own. Is there anyway my husband can stop me from moving that far before I file for separation? Should I wait until I move to do so? What are the laws in KY regarding moving before divorce? It would still be within KY, just 300 miles away.

Re: Relocation with Children during Separation

There are no laws restricting you from moving. Until a court orders otherwise, you and your husband have equal rights to the children. Every situation is different. Consult a local attorney (he/she may not even charge you for the visit)to seek advice. A one on one visit can develop facts that may lead to a good plan. Good Luck.
