Legal Question in Family Law in Kentucky

Shared Parenting for dad moving out of state

My husband wants shared parenting of his 2 year old daughter because we are moving from KY to AZ. Mom wants to fight this, we dont know why. Dad just wants to ensure he will be able to actively participate in her life. Can shared parenting happen when we are moving so far away? Is there really a way to do the 6mo/6mo thing? Do we have to have a lawyer for this? What are our chances of success since no legal custody has ever been established? Mom and dad have never been married. What forms do we need to file for this? Do we go to family court or juvenile court? Thank you!

Re: Shared Parenting for dad moving out of state

I am not sure what you mean by "shared parenting". Has paternity been established? Why is there not a custody order? The only thing that can be enforced is a written agreement. Without the establishment of paternity, your husband has little say in the matter unless all parties agree. You will need an attorney in this, especially since there will be two states involved.
