Legal Question in Family Law in Kentucky

Show Cause?

I am trying to collect unpaid amounts of money from my ex husband. To date he has been found guilty of contempt on 8 separate occassions. I am Pro Se, and do not know what motion to file. So far I have filed contempt motions, only to have the time limit extended and the threat of consequences. I think it is now time to file a Show Cause motion, but I can't find a sample of one. I have been searching the web for weeks trying to find a template to follow, and have come up empty handed. Is there a sample anywhere? Any help would be greatly appreciated!

Re: Show Cause?

A "show cause" motion is a motion for the Court to require the defendant/respondent why he should not be held in contempt for failure to comply or obey some order of the Court( in your case not paying money). Your best option is to write "Comes the movant and moves the Court for an order requiring the respondent to show cause as to why he should not be held in contempt for failing to comply with that order of this Court dated _____________ in failing to pay _________________ and in addition, the movant moves the Court to enter judgment in her favor in the amount of $_________________(whatever the amount is) with interest thereon at 12 % per annum until paid." What this does may get you a judgment that you can use to garnish wages or sell property. If you can get the judgment, you can force payment in most cases without returning to Court. The only thing the Court can do is put him in jail eventually which may (or most probably will) get you nothing.
