Legal Question in Family Law in Kentucky

My sister son has been sent to a foster home going on 15 months. The school system had press behavial charges. He was sent off of no fault of of my sisters. She has total cooperated DCBS over this 15 mnths. And they have had every reason they could think of not to let him come home. Now my sister has recently found out she has cancer,and they now want her to sing over her rights due to her heath. And let the foster parents adopt him.she has 2 other children living at home with her. I wanted to adopt him and they say I can't.can they stop me, and what are my chances of winning. Would I lawer up and fight. And what are her rights in this matter.and can they denie me, even if the mother and father agree he should be with me
