I want to get sole custody of my son. The father was an illegal immigrant and was deported. The last time he saw his son he was 2 months old; now he is 14 months old. The father refused to see the baby even if I made an attempt to get him to see him and has not payed anything for the baby, has never been there for his shots, nothing. He is not at all in contact with the baby and so I want sole custody. How do I go about doing that?

Sounds like you already have sole custody. If he can't return to the States, custody is a non-issue; you're the only parent available. If he suddenly showed up on your doorstep demanding access to your child and ranting about custody, you don't go to Family Court, you call ICE and they deport him again, after he serves time in federal prison for illegal reentry. Was paternity even established through DNA testing/a paternity action filed through the County Attorney's office? If so, you can always ask the court to terminate his parental rights if it will make you feel better. Talk to a local family law attorney about your options.
