Step-parent adoption/contested
My ex-husband has been mentally and physically abusive to our daughter. No police reports have been filed because he hasn't left any marks. He likes to choke her and push her into things. My husband wants to adopt her. (She's 12) My ex hates my husband and would never agree. Can my husband adopt her even though my ex hasn't left marks and wouldn't agree to it?

your word alone is not enough to establish abuse. The courts hear too many accustations of this type made in order to gain some sort of advantage in custody matters. If your ex will not agree, I do not see much hope for your present husband to adopt your daughter. Being abusive is not grounds for your present husband to adopt your daughter. Being abusive is grounds for restrictive or no visitation, etc. .
