can I still sue my ex-husband for a violation in our divorce decree? we live in louisville, kentucky. he had 5 years to pay me $10,000.00 for the equity in our home. the divorce was final in 2000. he has not paid me any of the money. can I still sue him for the money or is it too late?

It is not too late. You would file a Motion to Show Cause in the same case where the decree was issued. If that was not issued in Jefferson County, then you would need to file a Motion to Transfer the case to Jefferson County in whatever county the decree of divorce was entered. You need to look at the local rules of practice to see how to do a Show Cause (show cause why he should not be held in contempt) motion.

A judgment is generally good for 15 years and thus it should not be too late for you to collect. You should file a motion for contempt or to show cause and have your ex spouse served with the motion. You may need to do this through the county in which you were divorced. If you hire an attorney you may be entitled to recover attorney fees and costs for filing the motion.
