If u marry someone and u find out they r still married to someone else does ur marriage become legal after they divorce that person or do u have to get remarried for it to b legal?

Marriage where there is a husband or wife living, from whom the person marrying has

not been divorced, is prohibited and void under KRS 402.020(1)(b).

So, if you desire to have a valid legal marriage then you would need to remarry after the already-married spouse acquires a divorce.
