visitation rights

My brother had a child out of wedlock but was on the birth certificate. He recently passed away and I am scared that the mother of the child will not let me see my neice. Do I have any rights? I know the grandparents do.

I am very sory about the recent passing of your brother. You are asking about KY law and I am a TN attorney. I do not know about KY, but in TN there is a grandparent visitation statute, but that would not apply to aunts and uncles. I am afraid that if the law in Ky is the same as in TN your rights may have to be exercised through the legal rights of your parents, if any. I do not think you are going to be entitled to court ordered visitation. Please check with a KY lawyer in the jurisdiction of the child to check on this. Best of luck.
