Legal Question in Family Law in Kentucky

Hello I'm currently working on H1b and got married in india. he came to US on my visa and was dependent (non working i supported him) .soon we had a child in US but after he turned 18months my husband abandoned me(his purpose of marriage was gateway to USA so having trouble settling on H4visa ).even took my money(thousands of dollars) ..didn't come back but came in my absence n took his stuff and is living wiht his parents in india. he even called once and threatened to kill me n my family. but no contact from his side from last 9months. how do i proceed ...he totally abandoned me but i want divorce or separation because i dont want his name on my 403b or any thing i own. can i still file divorce in usa regarless where we got married.

You need to file for divorce or legal separation in the USA and in Kentucky as long as you have resided here for at least 180 days. Kentucky would have jurisdiction over the marriage regardless of where he is living. You will have to attempt to serve him (the court clerk will do this by certified mail) and, failing that, you may have to have a Warning Order Attorney appointed to serve him.
