Legal Question in Medical Leave in Kentucky

abuse of fmla policy

One of our employees has been taking intermittent fmla to provide transportation and care to her mother with cancer. Is she required to provide a note each time she takes her mom to have her chemo treatment? We suspect she is using her mom's illness to take off for reasons other than caring for her mom. How can an employer protect itself against employees who abuse the policy? We are a small manufacturing company with 130 employees of which the majority are in the actual factory. This particular employee using fmla time is the accounts payable clerk. There is no one else trained to do this job and when she is out for days on end it causes a hardship on the department. What, if any, options do we have to verify that she's not abusing this policy?

There are measures that you can take to protect yourself from abuse. You may find some guidance and useful information at the Department of Labor's website. (dol.gov) However, you should seek a more formal consultation with an attorney regarding your specific situation. You can contact me directly at [email protected], if you wish.
