Legal Question in Civil Litigation in Kentucky
Car Wreck
My husband drives a semi and backed up into an older small car. The car owner agreed to let my husband pay for the damage out of pocket to avoid a mark on my husband's MVR. The lowest estimate for damage was $100 more than the car was worth. The car owner wants a check for just what the car is worth and will not be making the repairs. Should he give us the car or does he get the check and keep his car both?

Re: Car Wreck
If you are trying to keep the record clean, you do not have much choice but to do what the car owner wants. An insurance company would probably want title to the car. You cannot afford to demand title to the car. What you are getting in exchange for your money is a continued clean MVR record. You can ask for the title but if the owner does not want to turn it over, then you have to accept it or go the conventional route.
