Legal Question in Civil Litigation in Kentucky
does demands for dismissal in an answer to a petition count as a motion for dism
After service of summons and original petition to defendant for a case in US District court; the defendant answers denying all allegations. Twice in the answer demand for dismissal is made. I read that I have 14 days to answer any motion filed on a docket. Does this count as a motion giving me the opportunity to answer? If so is it customary to answer as to why it should not be dismissed or is this just a customary demand that goes unchecked?
