Legal Question in Health Care Law in Kentucky
Employer dropping healthcare on Spouse.
My husbands Employer cancelled me off his healthcare insurance after a year. In Jan. of this year he was told he had to bring in marriage certificate to the insurance rep.So he did, i was diagnosed in Nov of 2009 with cancer, after having to go through many test and some surgical processor, I found out towards in the end of Feb i had no coverage, Which i was never notified by the employer or health insurance i was dropped.. When i called both the insurance company and employer the employer said The Marriage Certificate wasnt proof enough that we were still legally married. The Insurance company informed me that they didnt drop me it was the employer.. How can they get by doing this?? We are required to have it, but they can just drop people.. Kentucky..

Stinks of bad faith to me. I don't buy for a minute that it's all on the employer. Health insurance companies = evil. You should get a consultation with an attorney experienced in health insurance law as soon as possible to figure out if you have a solid case for breach of contract and bad faith, and make them cover your expenses while cutting you a big check for punitive damages. In the meantime, discuss the situation with your healthcare providers, so you can continue getting treatment, which is the #1 priority.
