Legal Question in Immigration Law in Kentucky
Hi This is Neal,
Currently I got the H1b Approval. But i can't able to go to my home country and get stamped. My question is is my h1b stamping is necessary to get H4 visa stamp to my spouse.?

Neal:
An H-1B visa is not necessary in order to obtain H-4 status for your spouse. However, you must be in H-1B status - meaning that your I-94 card must indicate that you have H-1B status. Your spouse must provide proof of your status, as well as the exsistence of the marriage.

You would have to be here legally on H-1B status for your wife to get H-4. Why did you not apply to change your status in the U.S. to H-1B? What is your current immigration status?
